Terms of Service - Gator Dumpsters

Welcome to Gator Dumpsters (“we,” “us,” or “our”). By renting a dumpster, using our website, booking online, or communicating with our team, you (“you” or “the Customer”) agree to the following Terms of Service (“Terms”). These Terms form a legally binding agreement between you and Gator Dumpsters. Please read them carefully. If you don’t agree with any part, do not use our services.

1. DEFINITIONS

1.1 “Lessor” means Gator Dumpsters, a Texas-based, family-owned dumpster rental company.
1.2 “Customer” means any individual or business renting a dumpster or using services from Gator Dumpsters.
1.3 “Dumpster” means the roll-off container delivered to the Customer’s property.
1.4 “Agreement” includes these Terms, any invoice or booking form, and policies referenced on our website or by staff.

2. RENTAL PERIOD & PRICING

2.1 Standard Rental Periods

15 Yard Dumpster: 3 day rental, 3,000 lbs. included – Starting at $380

20 Yard Dumpster: 3 day rental, 4,000 lbs. included – Starting at $430

2.2 Extra Days

Additional days are $10 per day beyond the initial 3-day rental.

2.3 Payment Terms

Full payment is due upon booking unless otherwise stated.

Extra charges (e.g., excess weight, overfilled dumpster, restricted items) will be billed separately.

Late invoices are subject to a 10% late fee if not paid within 14 days.

2.4 Rental Expiry

If no pickup request is made by the end of your rental term, we may retrieve the dumpster at our discretion and charge for any extra days and overages.

3. WHAT YOU CAN & CAN’T TOSS

3.1 Accepted Items

Household junk, furniture, yard debris, drywall, roofing materials, construction debris, general trash

Additional fees apply for certain items:

Mattress: $40

Refrigerated Appliances: $50

Tires: $35

3.2 Prohibited Items

Wet paint, hazardous waste, propane tanks, fuel, explosives, batteries, medical waste, and biohazards

If prohibited materials are found, pickup may be refused and fines may apply.

3.3 Overfilling

Items must not extend above the dumpster’s top rail or hang off the sides. Overfilled loads may result in service refusal and extra fees.

4. DELIVERY, PLACEMENT & PICKUP

4.1 Delivery

We deliver clean, branded dumpsters on time—usually same-day or next-day.

Customer is responsible for clear, safe access to the drop-off area. We are not liable for missed deliveries due to blocked or unsafe locations.

4.2 Pickup

Call or text us when you're ready. We’ll swing by for pickup or swap-out.

If we don’t hear from you after your term ends, we may auto-schedule a pickup and charge accordingly.

4.3 Driveway & Surface Disclaimer

While we use boards and aim for careful placement, heavy dumpsters may cause minor scuffs or surface marks. By renting, you accept this risk.

5. WEIGHT LIMITS & OVERAGES

5.1 Included Tonnage

15 yard includes 3,000 lbs.

20 yard includes 4,000 lbs.

Overages are charged at $50 per 1,000 lbs.

5.2 Final Weight

Weight is determined at the disposal facility. That weight is final unless independently disputed by the Customer with documentation.

6. COMMUNICATION & TEXT POLICY

6.1 Consent to Text/Email
By booking with us, you agree to receive service-related texts and/or emails (e.g., delivery, pickup, updates, and reminders).
6.2 Opt-Out
You can opt out anytime by replying “STOP” or unsubscribing via email. Note: opting out of service-related texts may impact your rental experience.
6.3 Privacy
We never sell or share your contact information. See our Privacy Policy for full details.

7. CANCELLATION, BREACH & TERMINATION

7.1 Cancellations

If you cancel before dispatch, we’ll issue a refund minus a $25 admin fee.

No refunds once the dumpster is en route or delivered.

7.2 Breach of Terms

If you fail to pay, overfill the dumpster, or dispose of prohibited materials, we may terminate your rental and retrieve the dumpster at your expense.

7.3 Legal Fees

You agree to cover any legal fees or court costs incurred due to violation of these Terms.

8. LIABILITY & INDEMNITY

8.1 Limitation of Liability
We’re not liable for injuries, property damage, or financial loss resulting from dumpster use, except in cases of proven negligence.
8.2 Indemnification
You agree to defend, indemnify, and hold us harmless from any claims or costs related to your misuse of our services or violation of these Terms.

9. WARRANTY DISCLAIMER

9.1 As-Is Services
Dumpsters are provided “as is” and “as available,” with no warranties or guarantees, express or implied.

10. GOVERNING LAW & DISPUTES

10.1 Governing Law
These Terms are governed by the laws of the State of Texas.
10.2 Dispute Resolution
All legal matters will be handled in the courts of Bexar County, TX, unless both parties agree to alternative resolution methods.

11. CHANGES TO TERMS

11.1 We May Update These Terms
We reserve the right to change or update these Terms at any time. Updated versions will be posted on our website with a new effective date.
11.2 Continued Use = Agreement
By continuing to use our services after updates are posted, you agree to the new Terms.

12. ENTIRE AGREEMENT

These Terms, along with any rental forms, invoices, or linked policies, make up the full agreement between you and Gator Dumpsters. Any verbal agreements not listed here are not binding.
